Code Enforcement Response Priorities

Priority 1 (Imminent Hazards)

Cases that pose imminent health and safety hazards or constitute significant code violations are given the highest priority, because they have the highest potential result in significant harm to the community. Priority 1 reports may be responded to on the same day. Examples include:

  • Illicit discharge - active
  • Housing complaints - no heat/electricity/water
  • Open foundations/excavations
  • Swimming Pools - secure and proper fencing (safety)
  • Raw garbage
  • Snow - complaint basis - winter
  • Unsafe trees - uprooted, damaged
  • Vacant buildings/board-ups

Priority 2

While Priority 1 issues have the highest priority immediate response, Priority 2 complaints will be responded to with an initial inspection within 48 hours from the Code Enforcement office receiving the request. Examples include:

  • Accessory structures - new placement/setback
  • Auto repair - residential
  • Auto repair business in residential
  • Building addresses
  • Business licenses
  • Exterior maintenance
  • Fences - front-yard setback/alignment/structural
  • Food vendors
  • Garage sales
  • Graffiti
  • Home businesses
  • Housing - other than imminent hazards
  • Illegal dumping
  • Illegal uses/district provisions
  • Landscaping
  • Lighting nuisance
  • Noise nuisance
  • Occupancy
  • Outdoor display
  • Overweight vehicles
  • Parking surface
  • Parking on landscape
  • Recreational vehicles
  • Retention walls
  • ROW violations (i.e. roll-offs)
  • Stagnant water
  • Sidewalk obstruction to include algae over sidewalk
  • Signs and signage issues
  • Trash and debris
  • Unlawful vehicles
  • Visibility triangles
  • Weeds - residential and vacant lots
  • Noxious emissions
  • Trees - dead and not an immediate hazard

Priority 3

Priority 3 issues, such as trash can placement/screening, result in a lower priority response. For first-time offenses, informational letters may be mailed to properties with a reported violation. Subsequent complaints will be handled with on-site inspections as resources allow within seven to 10 business days. Examples include:

  • Trash can screening/placement (initial response will be an informational letter)
  • Bus benches (referral to franchisee)
  • Accessory structure - already in place (complaint only)
  • Air Band B (complaint only)
  • Basketball hoops in streets (complaint only)
  • Christmas tree lot (complaint only)
  • Group homes (complaint only)
  • Illegal tree trimming (complaint only)
  • Sex offenders housing (complaint only)
  • Wood burning (October to April) (complaint only)

Issues not regulated by city Code Enforcement

  • Civil issues: landlord/tenant, fence line between properties
  • Animals: barking dogs (report to Animal Services)
  • Wildlife issues/prairie dogs (report to state Division of Wildlife)
  • Trees crossing property lines/other than right of way
  • HOA covenants issues
