UPDATE:

The Aurora Police Traffic Investigations Unit has concluded our investigation on this horrific crash which resulted in the death of two young men. Our extensive investigation revealed the following:

The driver of the black 2004 Infiniti G35 coupe was identified as Phillip Klemenov, 24, of Aurora. The front seat passenger was identified as Marcelous D. Johnson, 27, of Colorado Springs. The backseat passenger was identified as Adrianna Lemus, 18yo, of Aurora.

Lemus advised investigators that all three of them had been drinking alcohol all evening and into the morning, visiting several local drinking establishments in the Denver area prior to the crash. She and Klemenov were in an intimate relationship and tonight was her first meeting of Johnson.

Witnesses on scene, and first responders, observed Klemenov and Johnson trapped and upside down in the severely damaged vehicle that was overturned as a result of the crash. Klemenov in the driver’s seat, and Johnson in the front passenger seat.

Several trees and a light pole had impacted and gone thru the vehicle, particularly the front passenger compartment in which the two men were seated.

Members of the Aurora Fire Department had to cut the trees and crumpled vehicle damage away to extricate Klemenov out of the driver's seat. He was taken to a local hospital where he later died from his injuries.

Johnson was pronounced deceased on scene and remained there until Coroner arrived as per protocols.

Ms. Lemus stated she crawled out of vehicle through the rear windshield after the crash. Her minor injuries were consistent with where she said she was seated, and how the compartment where she was seated faired on scene.

Based on statements made by Ms. Lemus, and the evidence recovered from inside the vehicle, investigators believed alcohol consumption contributed to this crash.

A blood sample, per court issued warrant, was drawn from Klemenov at 3:55 a.m., about an hour and 10 minutes after the crash. It should be noted that prior to this blood draw Klemenov had already been administered 8 units of fresh blood and 4 units of frozen plasma by medical personnel in attempts to save his life.

Klemenov's blood alcohol content (BAC), after laboratory examination and testing, resulted in 0.139% BAC. 0.08% BAC or over is considered over the legal limit in the State of Colorado.

Evidence showed all three occupants were wearing seatbelts at time of the crash.

Our investigation concludes that this fatal crash occurred because Klemenov was operating a motor vehicle while under the influence of alcohol and/or drugs.

Klemenov was driving the Infiniti coupe eastbound on E. Florida Ave. at over twice the posted speed limit (73.6 mph in a posted 35 mph zone).

Evidence shows vehicle was eastbound on E. Florida Ave. going over the crown of the S. Dayton St. roadway causing the suspension springs to fully extend and compress making the vehicle bottom out (as seen by roadway evidence as bottom of vehicle left a scraping and rust transfer). This action caused Klemenov to turn the driver’s wheel to the left, causing the vehicle to go into a yaw, making him lose control of the vehicle. The vehicle straightened out and subsequently struck the curb on the north side of E. Florida Ave. The vehicle started to rotate clockwise due to the curb strike and continue up onto the landscaping grass bordering the roadway. The driver's door area was first to strike the first tree. The force of this impact sheared the tree and the vehicle continued its path. The front driver's wheel came off at this point and the vehicle started to dig into the soft turf of the grass. The vehicle tripped and started to roll over. The vehicle struck the second tree on the driver's "A" pillar area, and rolled over upside down and struck the third tree along with a light pole on the passenger side door area until coming to its final place of rest.

This investigation is closed with no charges due to death of offender.

Fatal Crash

On 11-25-16, at  6:45 pm, The Aurora Police and Aurora Fire Department responded to East 26th Avenue and North Picadilly Road on the report of a rollover crash. The crash scene was approximately 1/2 mile east of North Picadilly Road on East 26th Avenue.
The preliminary investigation showed a Chevy Tahoe was westbound on East 26th Avenue when, for unknown reasons, it went partially off the north side of the roadway. The driver tried to steer the Tahoe back onto the roadway but over corrected causing the Tahoe to roll approximately two times before coming to rest in the middle of East 26th Avenue. There were three occupants inside the Tahoe - an adult male driver and two juvenile male passengers. The driver and one of the juveniles had to be extricated from the Tahoe. All three occupants were transported to local area hospitals. Unfortunately, the driver and one of the juvenile males were later pronounced dead. The other juvenile male had minor injuries.  At this time, speed and alcohol do not appear to be factors in the cause of the crash. The Aurora Police Department Traffic Unit will continue its investigation of this crash.

Since the election, many questions have been raised about Aurora Police Department’s current non-enforcement policy on immigration. Specifically, people are asking if we intend to change our policy.

The simple answer is: No

APD's policy on immigration will remain as follows:

Officers will not enforce, investigate, or detain individuals based on their immigration status.

Our policy is not based on politics or personal philosophy. It is based on public safety. It is our goal to ensure that all individuals within Aurora feel safe in reporting emergencies and working closely with the APD to ensure our city remains a safe place for all.

The city’s responsibility is to provide services to all residents, enforce local laws and build strong community partnerships.
