Pedestrian versus Train Accident

E. 30th Ave & N. Peoria St 

  On February 19, 2017 at about 2:07 PM, Aurora Police and Fire responded to E. 30th Ave & N. Peoria St. on a report of a pedestrian being struck by a RTD light rail train on the R line.  There they found that a 35 year old Asian male had been struck and was unresponsive.  He was transported to a local hospital where he was declared deceased.

  The investigation thus far indicates that the male was walking east on the north side of 30th, west towards the light rail tracks.  The oncoming light rail train, which was in training operation with no passengers, was traveling south.  The safety equipment at the crossing was activated to include the arms that stop vehicular traffic on the roadway, pedestrian gates and illuminated signs with the international symbol for “Don’t Walk”.

  For an unknown reason, the pedestrian ignored the warnings, pushed through the gate and into the path of the light rail train.  The train operator immediately activated the emergency braking system but was unable to stop before striking the male. It appears that the male was hearing impaired and possible intoxication is also a factor being investigated at this time.

  The Aurora Police Traffic Unit will conduct the investigation in coordination with the Adams County Coroner’s Office, who will release the identity of the male at a later date.

I have been hearing concerns from members of Aurora’s diverse immigrant community on the subject of immigration enforcement. Many members of that community have fears of reaching out to the police and other emergency services in a time of need because of their documentation status. I want to reassure members of those communities that if they find themselves in a situation where they need help that they should not be afraid to call 911. Our policy remains the same…officers will not enforce, investigate, or detain individuals based solely on their immigration status.

Our policy is not based on politics or personal philosophy. It is based on public safety. It is our goal to ensure that all individuals within Aurora feel safe in reporting emergencies and working closely with the APD to ensure our city remains a safe place for all.

The Aurora Police Department is announcing the implementation of a new department initiative for enhancing community relations – the establishment of a Community Policing Advisory Team. This group was identified as a departmental goal in the most recent (October 2016) Initiatives for Enhancing Community Relations booklet

The Community Policing Advisory Team is comprised of members of our diverse community who will advise APD on a variety of issues to include, but not limited to:

§ Community policing and engagement strategies, as well as directly assist APD in community outreach.

§ Providing consultant advice to the department during times of crisis directly impacting the police and the community.

§ Provide advice and opinion pertaining to current or proposed policies, procedures and training.

§ Assist in creating mechanisms in improving communication between police and community.

§ Assist in creating mechanisms in how best the community can recognize great work by our employees.

There are currently 16 members of the Community Policing Advisory Team chosen by Chief Nicholas Metz from among public and private sector business partners, community groups, faith communities, and private citizens. Current membership includes representatives from Aurora Public Schools, Cherry Creek Schools, AKCRT (Aurora Key Community Response Team), the immigrant and refugee communities, the youth community, the business community, the Asian community, the Hispanic/Latino community, the NAACP, the Christian faith community, the Muslim faith community, the Aurora Human Rights Commission, and the Aurora Chamber of Commerce.

UPDATE:  Investigators have reviewed surveillance video at the railroad crossing. The videos show that the driver of the van pulls into the railroad crossing area and stops prior to the crossing gates being activated by the approaching RTD A-Line commuter train. He remains idle for approximately 38 seconds and then drives directly into the path of the train.  Investigators have now focused their investigations into whether or not the actions of the driver were intentional.

North Chambers Avenue and East Smith Road will remain closed until midnight tonight.

Information previously released on February 14th, 217 at 08:05a.m.

On Tuesday February 14, 2017 at approximately 3:49 a.m. a passenger van traveling south bound on North Chambers Road was struck by an eastbound A-Line RTD train while the van was on the train track between the crossing gates.

An Aurora Police Officer was present and working at this train crossing intersection, as well as an employee contracted by RTD, at the time of the crash and witnessed this incident. The Aurora Police officer attempted to stop the driver of the passenger van from traveling onto the tracks as the A-Line RTD Train was approaching on the tracks, but the van failed to stop and was struck by the train.   After the collision the train continued to travel for approximately 1/4 of mile before coming to a complete stop. The adult male driver of the van was extricated from the vehicle by the Aurora Fire Rescue Department. He was pronounced at the scene.

At this time we know 56 occupants were on board the RTD A-Line train. Four total patients were treated with only one being transported to a local hospital with non-life threatening injuries.

The identity of the driver is not being released at this time. His name will be released by the Adams County Coroner's Office.

The Aurora Police Department Traffic Section will be the lead agency investigating this crash. The Federal Railroad Authority and Regional Transportation District (RTD) are also involved with this investigation.

On Wednesday February 15, 2017 at approximately 2:30 a.m., Aurora Police Officers responded to the area of a tattoo shop located at 3095 S. Peoria St.  Officers responded in an attempt to locate a suspect who was wanted by the Federal Heights Police Department for domestic violence related charges.  The suspect, who is identified as John Arthur Thomas (DOB 07/21/1971), was believed to be at this location by the Federal Heights Police Department.  Officers eventually observed Thomas at approximately 4:45 a.m. outside of the tattoo shop and the suspect retreated inside of the business. 

Thomas made recent statements that he wished to cause harm to law enforcement Officers and was known to be armed and dangerous.  Officers on scene subsequently requested the assistance of additional specialized units, who responded to the scene.

After contact was established with Thomas inside the business, Thomas eventually surrendered without incident and members of the Federal Heights Police Department took custody of Thomas.

As a result of this incident, S. Peoria St. was closed between E. Cornell Ave. and S Parker Rd. but the road was reopened at approximately 11:00 a.m.

The Aurora Police Department appreciates the assistance, cooperation and understanding of the public and the media.  No further updates are expected at this point.

Aurora, CO. - January 25th, 2017-  The Aurora Police Department Traffic Section, in conjunction with multiple metropolitan law enforcement agencies, will be conducting traffic enforcement and education operations today in support of Colorado’s “Move Over” law.  The goal of this operation is to raise awareness and educate drivers on the law for the safety of our first responders out there on the roadways.  The Move Over law requires drivers to move over a lane when there’s an emergency situation along the shoulder.  If the driver can’t move over, they must slow down significantly to avoid an accident.  The law includes all Law Enforcement, Emergency vehicles, First Responders and Tow trucks.  This operation is in response to the tragic death of Colorado State Patrol Trooper Cody Donahue on November 25th of last year, who was investigating an accident on the shoulder of I-25 in Castle Rock, when a semi-truck driver failed to move over, drifted onto the shoulder, killing Trooper Donahue.  Our operations will be conducted on the I-225 and I-70 highway corridors for most of the day.  Most drivers stopped for violating the law will be educated and given warnings.  Those violations deemed more severe could result in a traffic summons being issued with fines and/or mandatory court appearances.

UPDATE-Press release from the 17th Judicial District Attorney's Office:

17th Judicial District Attorney Dave Young announced Friday that formal charges of first-degree murder after deliberation have been filed against Jose Luis Lozoya in the stabbing death of 18-year-old Alonzo Devault on Monday.
Aurora police responding to a 911 call found Devault with multiple stab wounds on the ground in a parking lot at 14551 E. Colfax Avenue on at about 12:20 p.m. on Monday, Jan. 16.

Lozoya (DOB 11/04/92) is charged with one count of first-degree murder after deliberation (F1). He was advised of the charge Friday morning and a preliminary hearing is set for 9 a.m. Feb. 21 in Division T of Adams County District Court. Lozoya is held without bond.

The filing of a criminal charge is merely a formal accusation that an individual committed a crime under Colorado laws. A defendant is presumed innocent until and unless proven guilty.

Information previously released on January 16, 2017

On January 16, 2017, at approximately 12:20 p.m. Aurora Police were dispatched to a report of a physical altercation between two parties in the 1600 Block of N. Eagle St. Upon arrival officers located an adult male who had been stabbed. Officers on scene rendered aid to the victim and rescue personnel were summoned to the scene. The victim was transported to a local hospital where he was pronounced deceased.

 
The suspect, an adult male,  was located by officers in the area. The suspect was taken into custody without incident. The identity of the suspect is not being released at time. They are actively investigating this case and interviewing witnesses.  

 

Detectives from the Major Crimes/Homicide Unit and Crime Scene Investigation Unit responded to the scene and took over the investigation into this case.

 

The name of the deceased victim will be released by the Adams County Coroner’s Office once they have positively identified him and his next of kin have been notified.

Today the Aurora Police Department was notified by the Arapahoe County Coroner’s Office that the body that was discovered in the Olympic Park Pond has been positively identified as David Puckett. No traumatic injuries were found during the autopsy. Further investigation and studies need to be completed before the Coroner can determine a cause and manner of death. 

The Aurora Police Crimes Against Children Unit is still actively investigating this incident to determine the circumstance surrounding David’s death.

Information previously released on January 3rd, 2017:

On Tuesday January 3rd, 2017 at 11:10 p.m. the Aurora Police Department conducted the first and final press briefing of the day on the grounds of the Yale Elementary School located at 16001 East Yale Avenue. The following information was shared:

Over 150 law enforcement personnel have assisted with the search in finding David over the past few days such as the FBI, Arapahoe County Sheriff's Office, NCMECArapahoe Rescue Patrol, Aurora Fire Rescue Technical Rescue Team and the Search and Rescue Dogs of the United States  (SARDUS) . Additionally, over 200 citizens from our community and beyond volunteered in our search effort. 

Jefferson County Sheriff Bloodhound "Jessie" was on the ground searching by 8:00 p.m. on the night David went missing. NCMEC bloodhounds searched throughout this investigation as well. Last night, we called in SARDUS who deployed a total of six human remain detection, trailing, and air scent dogs today and yesterday. One of those dogs expressed interest in a small pond in Olympic Park. The Aurora Fire Rescue Technical Rescue Team was deployed and found the body of a child inside the pond underneath the ice. At this time we cannot give positive identification.

Chief Metz has informed the Puckett Family of this information, and they are also aware positive identification will take some time.

We are treating the Olympic Park pond as a crime scene. Crime Scene Investigators and the FBI will be conducting a thorough investigation to determine what happened.

This area has been heavily search by law enforcement officers, citizens and the Puckett Family numerous times since David went missing. There was never any evidence someone fell into the pond or through the ice. At this time, our search efforts have not stopped as we have not positively identified the body as David's.

We will not be conducting any further press briefings. All new updates will be published via our social media sites on Twitter and Facebook.

The family has requested privacy and asked we notify the media they do not wish to be interviewed at this time. The Puckett family has specifically asked we share their deepest gratitude and appreciation to everyone who has helped in the search for David.

At this time the family has not authorized any fundraising efforts. If an authorized fundraising site is organized we will share that information via our social media sites.

We would like to continue to thank the public for their continued support in helping us find David, and again thank you to the media who have played an important role in helping us find David.

We began with answering questions from today's earlier press briefing, and provided the following answers:

David was confirmed to have been seen by someone other than his family earlier on Saturday.

David went missing approximately one hour prior to the Aurora Police Department being notified. The reason for the delay was the family began searching for David in locations they believed they might find him.

David has three other juvenile siblings living in the home.

The family has been cooperative with police, and investigators have thoroughly searched the home multiple times.

We are speaking with all known sex offenders in the area as part of our investigation.

The FBI coordinated road canvasses today. This is just another tool we use to help bring awareness to finding David.

A Jefferson County Sheriff's Office Bloodhound responded immediately to the scene the night David went missing.

Arapahoe Rescue Patrol and officers, have checked bodies of water in the area.

We are asking for the public to call our tip lines immediately if you believe you have found something of interest to this investigation. Additionally, we are asking everyone to not share or report those items on social media as they are not monitored 24/7, and we would like an officer to respond immediately.

The public can help by physically searching their homes, automobiles, and any structures on their property where a child may be able to hide. Children may not respond to you by simply calling their name, so its important to physically search these areas.

We confirmed missing 13 year old Fabian Xavier Rosales as found safe at a friends home. 

We have been in constant consultation with the Colorado Bureau of Investigation (CBI) reference the issuance of an Amber Alert since New Years Eve. Due to the passage of time, the impending weather, and out of an abundance of caution and to leave no stone unturned, CBI has issued an Amber Alert today at approximately 2:40 p.m.

Today marks three days in our search in #FindingDavid.

Today officers continued to conduct thorough neighborhood canvasses, and interviews.

We are looking for residential and commercial videos. If anyone has video they believe would be beneficial to this investigation please call our tips lines at 303-739-1865, 303-739-1868 or 303-739-1870.

Aurora Police Chief Nick Metz and the entire command staff have been and continue to be heavily involved in the investigation.

APS has been actively involved since the beginning of this investigation. They sent out alerts to parents of students at Dartmouth Elementary where David attends school. They have also prepared to have mental health professionals on hand to assist students, parents and staff as needed.

 Previously released on January 1, 2017:

On Saturday December 31, 2016 at approximately 5:45 p.m. Aurora Police officers responded to a residence in the 15700 block of East Amherst Place in reference to a missing at-risk six-year-old boy.


Officers learned the missing boy’s name is David Puckett. David is believed to have wandered from his home.  He is considered at-risk due to his young age. He has wandered from his home in the recent past, and was located by citizens. 

David is a white male, approximately 3’02” tall, and 55 pounds. He has brown hair, and brown eyes. He was last seen wearing green camouflage pants, a black t-shirt, black boots with a little bit of orange trim, and a light girls Army style tan jacket.

Since David has been reported missing, at least three Reverse 911 calls have been issued. The reaching over 27,000 Aurora residents within a 2 ½ mile radius from his home.

In addition to Aurora Police patrol officers searching for David, we activated our Emergency Response Team (ERT), and Strategic Response and Tactics (SRT) Team. The Major Crimes Unit, and Crimes Against Children Unit are also actively involved in this investigation with the assistance of The National Center for Missing and Exploited Children (NCMEC), and the Federal Bureau of Investigation. NCMEC also provided two bloodhounds for the search today.

The Aurora Citizens Police Alumni Association, which has over 400 volunteers, deployed their Citizens Missing/Abducted Response Team (CMART) immediately last night, and today.  

We want to thank our local law enforcement partners for providing immediate assistance in the search for David last night and today.

The Denver Police Department Air One Helicopter equipped with an infrared system, provided air support last night while a Bloodhound from The Jefferson County K-9 Team was on the ground searching with Arapahoe County Sheriff’s deputies.

On 12-30-16, at 9:30 p.m. Aurora Police and Aurora Fire responded to the report of an auto/pedestrian crash at East Colfax Avenue and Nome Street. The on-scene investigation revealed an adult male pedestrian was crossing East Colfax Avenue mid-block between Nome and Oswego Street, from the North to the South, when he was struck in the westbound lanes of Colfax. The male was transported to a local hospital where he was pronounced dead. The vehicle that struck the pedestrian left the scene. While officers were on scene, witnesses pointed out as the run vehicle drove eastbound on East Colfax Avenue past the crash scene. Officers were able to stop the run vehicle a few blocks away. The adult female driver was taken into custody and transported to jail. The driver is being held on a $20,000 bond. She is charged with Vehicular Homicide, Leaving the Scene of a Fatal Accident, and DUI. The Aurora Police Department Traffic Unit is handling the investigation. The names of the parties involved are not being released at this time.

UPDATE: The Aurora Police Department District 2 Detective Unit is seeking the public's assistance in obtaining photos and videos of last nights disturbance at the Town Center of Aurora. Detectives are particularly interested in obtaining photos and videos that show criminal activity such as fighting, assaults, and property damage.

Information previously released on December 26th, 2016

At approximately 4:45 this afternoon Aurora Police responded to a large disturbance at the Town Center of Aurora (14200 East Alameda Parkway).

An APD officer that was working off-duty encountered a fight that was taking place in the Food Court. When the officer went to arrest one of the subjects involved he was surrounded by a unruly crowd. As the officer was attempting to escort the arrestee to the Aurora Police Substation inside of the Town Center the crowd continued to advance on the officer and several other fights broke out. A citywide call for help was aired over the radio and all available APD units responded to the center.  The crowd grew in size to approximately 500 people (mostly juveniles). After consultation with Town Center management the decision was made to close the mall in the interest of public safety. 

Assistance was requested from the Denver Police Department and Arapahoe County Sheriff's Office. Early estimates show that over 50 law enforcement officers responded to the Town Center. 

During the incident several skirmishes occurred in the parking lots of the Century Theatre and the RTD Centrepoint Station. One male was assaulted at that location, his injuries were not serious.

Fortunately, there were no serious injuries during the disturbance, one arrestee had very minor injuries and no officers were injured. 

5 arrests were made, all of the suspects are juveniles. Charges they are facing include Disorderly Conduct, Obstruction, and Resisting Arrest.

It is believed that a post on social media announcing a fight at the Town Center is what drew this unruly crowd to the Town Center of Aurora.
